When Congress passed the Telecom Act of 1996, they eliminated the FCC's statutory authority to review telecom mergers by repealing Section 221 (a) of the Communications Act of 1934 with the intent to return the function of reviewing mergers to the Attorney General's Office. The FCC, however, has devised a random subjective system for review that is imprudently broad, arbitrary & capricious. The Committee hopes to clarify the congressionally intended scope of the FCC's merger review authority.
