What Is A General Power Of Attorney? A Power of Attorney is a document which authorizes another person to act on behalf of the individual granting the power of attorney. The person giving the power is called the Grantor and the person granted the power is called the Attorney-in-Fact. Anyone may be the attorney-in-fact. There are two different types of power of attorneys this kit will cover: 1. A General Power of Attorney authorizes the attorney-in-fact to act in behalf of the grantor, in all transactions and affairs. 2. A Special Power of Attorney only authorizes him or her to act on specific matters. For example, the selling of real estate. What Can Be Bestowed With A Power Of Attorney? A mother may wish to give her adult son a General power of attorney granting him authority to handle all her financial affairs. A businessman who is going to be absent from his place of business may wish to leave a Special power of attorney with a trusted employee that will be authorized to handle only the grantor's business affairs while he is away. The key element in granting a power of attorney is trust. The grantor should have complete faith in the person granted the power of attorney because he or she may have unbridled use of the grantor's assets. Any misuse or embezzlement by a person holding the power of attorney can be a crime and subject to a civil action for return of assets. With the use of this kit, you can set up your power of attorney to include (but are not limited to) the following powers: * Real estate transactions * Bond, share and commodity transactions * Business operating transactions * Claims and litigation * Chattel and goods transactions * Banking transactions * Insurance transactions * Virtually any other matter The forms are simple to prepare. Just fill in the blanks, sign in front of witnesses and a notary, and the document is legal. Once the completed forms are given to the attorney-in-fact, he or she may make copies to use in the transaction of the grantor's business. Once granted, the power of attorney remains in effect until revoked by the grantor. That is why also included in this kit is a Revocation of Power of Attorney form. This form is to terminate such power.
