Previous reports on nursing homes (NH) concluded that enforce. actions, known as sanctions, were ineffective in encouraging NH to maintain compliance with fed. quality require.; & sanctions were often rescinded before being implemented because NH had a grace period to correct deficiencies. In response, the Centers for Medicare & Medicaid (CMS) Serv. began requiring immediate sanctions for NH that repeatedly harmed residents. Using enforcement & deficiency data, this report: analyzed fed. sanctions from FY 2000 through 2005 against 63 NH previously reviewed; & assessed CMS¿s overall mgmt. of enforcement. The 63 NH had a history of harming residents & were located in 4 states that account for about 22% of NH nationwide.
